Privacy Policy and Terms of Use
Yum Restaurant Services Group, Inc. (“YRSG”), its commonly owned affiliates (including A&W Restaurants, KFC, Long John Silver’s, Yum Restaurants International, Pizza Hut and Taco Bell, each a “Brand,” together with YRSG collectively referred to as “Yum”), and its participating franchisees or licensees of a Brand (collectively, “Franchisees”) (Yum, together with Franchisees collectively referred to as the “Yum System.”) provide this website (“Site”) to individuals seeking an opportunity to submit an application for consideration for employment positions at either a Brand restaurant or at one of the Yum Restaurant Support Centers located either in the United States or internationally.
Collecting and Processing Personal Information
In order to administer this Site effectively and to process your resume or application for consideration, you must register on this Site. Once you are registered on the Site, we collect a variety of information about you, which may include: name, address, telephone number, email addresses, and any other information you may voluntarily provide as part of the application process provided through this Site (hereinafter defined as “Personal Information”). Further, after registering, YRSG (who administers this Site) and YRSG’s “service provider,” currently Kronos Incorporated (who hosts this Site), will use your Personal Information for any of the following purposes: (1) to administer this Site (including how this Site is used and how to making any on-going improvements); (2) to process your application or resume; (3) to register users for online activities such as: employment applications, comment forms, or any other online interactive activities; (4) to respond to specific requests from users, such as providing notices of special promotions, offers or solicitations (unless prohibited by law) from a Brand; (5) to protect the security or integrity of this Site, if necessary; or (6) to comply with applicable law or legal process.
You will have the choice whether or not to disclose such Personal Information on this Site; however, some parts of this Site and some services may be more difficult or impossible to use if you choose not to disclose Personal Information. If you are based outside of the United States, such use of this Site will include transferring your information to servers in the United States for processing.
In addition to the Personal Information identified above, our web servers, along with Yum’s service providers’ web servers, automatically identify computers by their IP addresses. YRSG and Yum’s service providers may use IP addresses to analyze trends, administer this Site, track users’ movement and gather broad demographic information for aggregate use. To emphasize, IP addresses are not linked to Personal Information.
Further, this Site may use technologies such as “cookies” to provide visitors with tailored information upon each visit. Cookies are a common part of many commercial websites that allow small text files to be sent by a website, accepted by a web browser and then placed on your hard drive as recognition for repeat visits to this Site. Every time you visit this Site, YRSG servers, through cookies, pixels and/or GIF files, collect basic technical information such as your domain name, the address of the last URL visited prior to clicking through to this Site, and your browser and operating system. You do not need to enable cookies to visit this Site; however, some parts of this Site and some services may be more difficult or impossible to use if cookies are disabled. To emphasize, cookies are not linked to any Personal Information while on this Site.
Sharing Personal Information
When registering for this Site, you give consent for your Personal Information to be shared only with individuals or entities (which may include Yum service providers) who need to know the Personal Information for the purposes of the proper and efficient operation of this Site and for Yum System Human Resources administration. If you are based outside of the United States, this will require that your Personal Information be transferred to, processed, and stored on central servers in the United States or sent to individuals in the United States. The laws regarding data privacy in the USA and other countries outside the European Economic Area (the “EEA”) may provide less adequate protection for the rights and freedoms of individuals than do the laws which apply within the EEA. However, your Personal Information will be processed in accordance with this Privacy Policy no matter where it is transferred.
In the case of processing a submitted resume and/or employment application, the Yum System may, where permitted by law, disclose your Personal Information to ChoicePoint and any other third party necessary to further process your resume and/or employment application.
When your Personal Information is transferred to service providers, it is done under a contract which requires the companies to use the shared Personal Information only for the limited purposes for which it is provided to them, not to transfer the Personal Information to another party, and to agree to hold the information securely and confidentially.
In addition, circumstances where this Site registration information would be disclosed may include:
- When you have consented
- Within the Yum System in order to provide human resource administration, general business organization and governance purposes
- To comply with applicable laws
- To third parties as required by law or court order
- To cooperate with government authorities in a criminal investigation or to detect or investigate crime
- To defend your legal rights or the rights of others, including the members of the Yum System, its service providers
- To obtain legal advice on behalf of the members of the Yum System and its service providers.
In addition to adhering to this Policy, and other policies and procedures regarding the privacy of personal information that Yum has in place, when your Personal Information is transferred from the EEA, Argentina, etc. to the Yum System in third countries, we require the recipient entity to enter into a contract regarding the use and processing of that information which incorporates certain standard contractual clauses approved by the Commission of the European Union.
Access
You control the accuracy of your Personal Information. If you applied for a restaurant position, your application is active for 90 days in our system. You may update your Personal Information by completing a new application or you may choose to delete your application entirely by e-mailing HZAdministrator@yum.com. Conversely, if you applied for a position other than at a restaurant, you may update your Personal Information or review your Personal Information that Yum has on record, by contacting HZAdministrator@yum.com.
Opting Out of Future Communications
Users, who initially opted-in to receive future offers or promotional materials (where permitted by law), or to allow the sharing of Personal Information with third parties, may subsequently opt-out by sending an e-mail to HZAdministrator@yum.com, or by responding to the opt-out link contained in any e-mail.
Security
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of your Personal Information, we have put in place, and have required all service providers to put in place, certain reasonable physical, electronic, managerial and security procedures to safeguard and secure the Personal Information collected through the program. As noted below, it is very important that you maintain the secrecy of your password.
Collection of Children’s Information
This Site is not intended for use by individuals under the age of 16. We do not knowingly collect personally identifiable information from any person under the age of 13, on or through this Site. If you are under 13, please do not submit any Personal Information through this Site. If you have reason to believe an ineligible person has provided Personal Information through this Site, please contact us and we’ll endeavor to delete that information from our databases.
Existing Employees Use of this Site
The provisions of this Privacy Policy apply to all existing Yum System employees who utilize this Site. In addition to the Privacy Policy provisions set forth above, the following additional provisions apply exclusively to existing Yum System employees.
- A. Use of Personal Information
- If you apply for a position through this Site, your employer may contact your Division/BMU Lead, HR Manager and/or your supervisors as part of evaluating your qualifications for the position(s) applied for. An important part of the internal development and posting process is to ensure that your supervisor and the team responsible for filling the open positions are aware of your interest in internal opportunities. Please follow the following steps when applying for internal positions:
- Discuss the position with your current supervisor prior to posting.
- Complete the online application process through this Site.
- Send e-mail notification of your application to your supervisor, your HR Generalist or People Capability Leader, and the Staffing Leader listed in the job description.
- B. Access to and Correcting Information
- If you applied for a position other than in a restaurant, as an alternative to updating your Personal Information, you may contact your Division/BMU Lead to access or correct any Personal Information submitted through this Site.
- C. Questions/Concerns
- Any questions or concerns you have regarding the use or disclosure of Personal Information related to the application and hiring process through this Site should be directed to your Division/BMU Lead.
- D. Compliance
- Yum, the Brand, the Franchisee (when applicable), and your employer, will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Information in accordance with the principles contained in this Privacy Policy. In addition to such investigations, we monitor adherence to this Privacy Policy and investigate suspected infractions. Any employee that misuses this Site will be subject to disciplinary action, which may include termination.
Intellectual Property
This Site, including but not limited to text, content, photographs, video, audio and graphics, and business management tools accessed through this Site are protected by copyrights, trademarks, service marks, international treaties and/or other proprietary rights and laws of the U.S. and other countries. The trademarks, service marks, trade names, trade dress, logos, designs, and sounds associated with this Web site are owned by Yum! Brands, Inc. and/or the Brands. You agree to abide by all applicable copyright, trademark, and other laws, as well as any additional copyright notices or restrictions contained in This Site.
This Site may also contain references to other company, brand and product names. Any company, brand and product names used herein are for identification purposes only and may be the trademarks of their respective owners. The images of people or places displayed, forms, structures, and graphics displayed or found within this Site are either the property of, or used with permission by the Yum System. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of This Site or these terms and conditions must be filed within one (1) year after such claim or cause of action arose. Use of This Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph.
These Terms constitute the entire agreement between you and the Yum System with respect to the use of This Site.
If any provision of these Terms is declared invalid or unenforceable, such provision shall be struck from the Terms and the remaining provisions shall be given full force and effect.
